Family Migration in Australia:

Visa Programs:
Partner Visa
  • Sub classes 820:

This subclass visa is the first step of acquiring permanent partner visa. This visa allows its holder to stay with its partner temporality in Australia until the process and decision for permanent partner Visa has been completed.

  • Subclass 801:

This subclass visa allows the applicant, spouse of an Australian Citizen or permanent resident, to stay in Australia permanently. There is one condition that the applicant must be present in Australia at the time of decision making of visa.

  • Subclass 300:

This subclass visa is for those who intend to marry their spouse whose who is either an Australian Citizen or a Permanent Resident and they themselves live abroad and not in Australia. This Visa grants them a temporary stay of 9 months in Australia.

Eligibility:
To be eligible for these visas you must:
  • Be married or be in a de facto relationship with
    -An Australian Citizen
    -Permanent Resident
    -An eligible New Zealand citizen
  • Have an authentic marriage under the Australian Law. If you are 16 or 17 years of age then you must have parental permission
  • Have been in a de fact relationship for at least a year

Parent Visa:

  • Subclass 103:

This subclass of visa allows Australian citizens or permanent residents to sponser their parents who live abroad to come and live with them.

Eligibility:

To be eligible for this visa:
  • You must have a child is an Australian PR or citizen
  • More of your children must be living in Australia rather than any other Country
  • You must meet the requirements of family test.

Child Visa:

  • Subclass 802:

This subclass of visa is for Australian Citizen or PR parents who wish to sponsor their child who is already in Australia to stay here permanently.

  • Subclass 101:

This subclass of visa is for Australian Citizen or PR parents who wish to sponsor their child who is living abroad to come and stay with them permanently.

Eligibility:
To be eligible for this visa:
  • Child must be single
  •  Special Age requirements must be fulfilled
 Relative Visa:
  •  Subclass 838:

 This visa is for those individuals who are of considerable age and are dependent on on a relative who is aAustralian citizen or PR then they can be sponsored to come and live with their relatives in Australia.

  • Subclass 115:

This visa is fr those individuals who live abroad but most of their close relatives are Australian Cititzens or PR then they can be sponsored by their relatives to come join them in Australia permanently.

Eligibility:
To be eligible for these visas you must:
  • Be related to
    -An Australian Citizen
    -Permanent Resident
    An eligible New Zealand citizen
  • The person who is sponsoring you must be older then 18 years of age

Family Migration in Canada

Canada understands the importance of family and belives in family reunification. That’s why it has the Family Visa program specific for immigratsnt tbe able to renuine with their families. Citizenship and Immigration Canada (CIC) has a specific visa program for family reunification called the Family Visa program. Canadian Citizens or Permanent residents can sponser the following Family Members:

  • Spouse, Common-law partner, Conjugal partner
  • Dependent children
  •  Parents
  •  Brothers and sisters
  • Grandparents
  • Grandchildren
  • Other relatives (i.e., an orphaned niece or nephew)

There are a wide range of categories through which Canadain citizens and Permanent residents can sponser their family members through:

  • Spouse, Common-Law Partner, Conjugal Partner Visa
  • Dependent Visa
  • Parent and Grandparent Super Visa
  • Family-Based Provincial Nominee Visa
  • Family Sponsor Visa

Each category has its own requirements that must be met in order to be eligible for the visa

  • Send an invitation letter to the family member they are sponsoring
  • Show proof that they will be able to financially support the family member during their initial stay (varies from between 3 to 10 years)
  • Sign an agreement stating that they recognize their mutual responsibilities and obligations
  • Sign an undertaking promising that they will provide the basic needs to the family member they are sponsoring

Family Migration in USA:

There are two types of famil- based Immigration visas in the US:

1. Immediate Relative Immigrant Visas
(Unlimited):

This type of visa is for the close immediate relatives of US citizens termed as Immediate Relative(IR). Number of immigrants allowed each year in unlimited. IR visa type include:

  • IR-1: Spouse of a U.S. Citizen
  • IR-2: Unmarried Child Under 21 Years of Age of a U.S. Citizen
  • IR-3: Orphan adopted abroad by a U.S. Citizen
  • IR-4: Orphan to be adopted in the U.S. by a U.S. citizen
  • IR-5: Parent of a U.S. Citizen who is at least 21 years old
2.Family Preference Immigrant Visas (Limited):

This visa is for those individuals who are distant relatives to an US citizen and for those who have some specific relationship towards Lawful Permanent Resident(LPR). This type of visas are limited per year and mentioned below in brackets after each type:

  • Family First Preference (F1): Unmarried sons and daughters of U.S. citizens along with their minor children, if they have any. (23,400)
  • Family Second Preference (F2): Spouses, minor children, and unmarried sons and daughters (age 21 and over) of LPRs. (114,200)
  • Family Third Preference (F3): Married sons and daughters of U.S. citizens, and their spouses and minor children. (23,400)
  • Family Fourth Preference (F4): Brothers and sisters of U.S. citizens, and their spouses and minor children, provided the U.S. citizens are at least 21 years of age. (65,000)
Requirements:

Following requirements must be met in order to apply for this visa:

  • US citizen must be 21 or older in order to sponser siblings or Parents.
  • The Sponsor must have principal residence in the US.
  • The sponsor must send an invitation letter to the family member they are sponsoring.
  • Sponsor must show proof that they will be able to financially support the family member during their initial stay (varies from between 3 to 10 years).
  • The intended immigrant has to apply for green card/ Permanent Residence.
